LA Criminal Attorneys - Arrested in Los Angeles If you are arrested for any crime including: drug crimes, sex crimes, violent crimes, white collar crimes, DUIs, as well as others, you are entitled to legal representation. If you waive your Miranda rights and give up your right to counsel, the police can question you. Rubenstein. Once you ask for an attorney the police cannot question you without one. People often say to us “My rights were not read to me”, you must understand that Miranda rights only apply to “interrogation” when you are “in custody”. A police officer can question you if they have a suspicion that something is wrong but you are not yet under arrest. You are under arrest when you are “not free to leave”. Once the police have handcuffed you or put you in a locked interrogation room, you are considered by the law to be in custody and not free to leave. Your Miranda rights apply at this point. Even if you are told to “stand over there”, “sit on the curb”, or taken into an interview room you may be, in the opinion of the Los Angeles Police Department or the Los Angeles Sheriffs Department you are “Free to leave”. If you are being questioned and before you answer any questions ask the police “am I free to leave?”, if they say “yes” leave and immediately contact the criminal defense attorneys at The Law Offices of Jeffery K. Rubenstein. If they say “no” then say the magic words “I want to speak with my attorney”. By law they are not allowed to question you any further. If you are arrested, the police have 72 hours in which to file a criminal charge against you (that time may be extended if the 72 hour mark falls on a legal holiday). Within that time they must file charges against you or release you. Even before charges are filed, you are entitled by the US Constitution to a reasonable bail. At The Law Offices of Jeffery K.
