Petty Theft

Taking something from another individual or business, whether the offense is committed by a juvenile or an adult, constitutes theft. There are many different crimes which can fall under the category of petty theft, such as:

  • Shoplifting
  • Theft by deception
  • Simple snatch and grabs
  • Pick Pocketing
  • Skipping out on a restaurant bill
  • Stealing a bicycle or other personal items

Petty theft is the catch-all term for a crime involving goods or services that are valued at less than $400. Petty theft is generally charged as a misdemeanor, especially if it is your first offense. If you have any prior convictions for petty theft, the penalty can be much more severe, and the crime can be charged as a felony. The law offices of Jeffrey Rubenstein are well-versed at representing individuals charged with petty theft, and your aggressive defense begins as soon as one of out attorneys takes your case. Our attorneys lay the groundwork, as you wait for your hearing or trial, for the best outcome possible.

Deferred judgment or diversion has become an option in many states when it comes to petty theft. If you have never been convicted of petty theft or a related charge, and you have never participated in a diversion or deferred judgment program, you may be eligible. A diversion or deferred judgment program will have the charges dropped under the condition that you do not commit another crime in the course of your probation period. While you'll still be responsible for paying court fees and fines, one of these programs will keep the charge of petty theft off your permanent record. That way, you won’t run the risk of discouraging future employers from hiring you because of a theft charge on your record, and you can avoid the embarrassment that such permanent charges often bring.
