Assault Definition

A crime of violence against another person. In the United States, assault may also only refer to the threat of violence caused by an abrupt show of force.

Aggravated Assault

Aggravated assault occurs when the offender intends to do more than merely frighten the victim.

Aggravated assault can occur in a variety of ways:

  • An infliction of a serious injury on another
  • Assault accompanied by intent to rob, rape or kill
  • The use of a deadly or dangerous weapon to intentionally place someone in imminent fear of serious injury
  • When a person causes serious injury to another while driving while intoxicated
  • Assaulting a police officer, teacher, prosecutor, health care provider or prison guard
  • An assault by an adult on a child under the age of 15

Battery Definition

Intentional unpermitted act causing harmful or offensive contact with another person. Technically the contact must be intended however it does not require the offender to indent harm or injury.

When battery is committed with intent to do serious harm or with the use of a dangerous weapon it is considered Aggravated Battery.

Difference Between Assault and Battery

The essential difference between assault and battery is the actual contact.

For example: throwing a blunt object at another with the intention to cause harm would be battery if the object did in fact hit the other person. If the object missed, it is considered assault.
